there is no SoL in Ontario in regards to the repayment of debt. If you do not pay your debt after the 6 years + 1 day, you are still responsible. Maybe if it's such a big deal to you...pay your bill.

Or move.

Thanks everyone -- the clarification between provincial and federal helps too.

Joyfulchaos,

No one is saying there is no sol on your loan. What I am saying if the loan is twenty years old; in my opinion it's safe to say you’re not going to get sued.

Cheers

The claim that there is no SoL for government loans is incorrect and overstating the situation.

There is no SoL for the provincial component of student loans in Ontario. The federal part has a SoL of six years.

Other government loans have a SoL of two, six, or fifteen years depending on the type of loan.

I appreciate the help -- there's been so much with the 2 years and the 6 year SOL, however in Ontario anyway, stating that there is **NO** SOL when it comes to government loans --- Are you well versed with Ontario law?

I already answered your question earlier. The debt is twenty years old and they can no longer sue you and I would just ignore them and move on with life.

I'd more than like to, however they say they can affect credit rating, which I can't afford. I don't have anything to 'fight' them with -- they can't (won't?) even tell me the contact name of the origin creditor. (Government has many departments) ARO says he doens't even have it, just a bunch of emails etc...
I feel like sending them registered mail stating that it's being disputed and take me to small claims for the $1000 and allow the court to make judgement?
Question 1: Does anyone know the statute of limitation for THE GOVERNMENT (Is there one?)
Question 2: If I request this to go to court to dispute, can ARO damage my credit rating before judgement?

thanks again,
Gwen

ARO & Gov't SOL

Postby joyfulchaos » Mon Feb 22, 2010 04:36:26 PM

Hello, I have been contacted by ARO in January of 2010 for an old loan that I thought was long paid out in the early 1990's! We are nearly at 2 decades later. I have no paperwork for this, and actually don't recall the bank that the loan was even issued under -- this is a 'life time' ago for me.

I mentioned Statute of Limitations to ARO, however they state that there is non for the Ministry of Government Services. (as this was a Ventures Loan)

Can someone confirm either way if the SOL applies to the government before I have to go on a wild goose chase and open a can of worms for nearly 20 years back to confirm the validity of this? I'm sure it was paid off in full, yet I don't have records going back that long. (For the record, this is the FIRST I'm hearing of this since that time. No one, not the bank, not anyone from the government has ever contacted me over this small loan, therefore I was long under the understanding that there wasn't a problem and this was paid off.)

thank you,
Gwen
