just ignore their calls...scams are spread all over the world nowadays...that may be one of 'em...if they ask for some information, which you think need not be discussed to a stranger, might as well put down the phone...don't just disclose any important information...

hi all, felt your anger. i got blindsided by ctoptions mc. big time in '08. anyway you do have options in small claims court, as filing a defence, if that doesn't work file a defendants claim, finally go after each individual, and company separately in small claims court. of course you have to prove your defence and claim..here's a tip..do not throw away the envelope, it has the postmark, and compare that to when papers were filed and the lawyer prepared them.. in my case it's my smoking gun..if you honestly feel you've been mistreated and/or misled, fight them, forms are on the web, filing fees are minimal..

Oh and no they have not told me what the debt is for, from who, how much or even when this debt was incurred.

And thanks,
I will ignore them and do the checks.

Thanks again

Don't give them any information or even talk to them in the future. The debt is almost certainly stat barred so their only hope of collecting is to annoy you into paying. If they notice that you get upset or agitated that gives them hope since people don't like to be upset and will pay money to make it stop. If you come off as cool and not concerned they might realize they are wasting their time and move on.

If they continue to call frequently there is a form letter I whipped up in a topic called cease and desist that you can use that will hopefully make them stop. I personally don't see the point of communicating with them in writing and would just suggest screening your calls until they get bored and move on.

I would go and immediately buy either a Equifax credit report or if credit is important to you Credit Watch. If they attempt to do anything fishy with your credit come back and post about it and we'll give you further guidance.

Also you could remind them that they are not allowed to contact you without first communicating in writing the details of the debt. Further, when they do contact you they are required to identify themselves and the lender they are acting on behalf of. It seems that they have not done either.

I would not offer anymore personal information. I would ignore their calls because if you do have a debt you don't remember the sol is past and the last thing you want to do is admit to it. Also you should have received something in writing before they started to call you by law. If you’re going to talk to them have a telephone recorder and record your calls without their knowledge.

What to do next?

Postby Justanother » Fri Feb 12, 2010 05:55:47 PM

Hello, I hope someone can give me some advice or some type of info on my situation.

I recieved a phone call for the first time in my life from a collection agency and I have never had any outstanding debt, I have always paid my bills on time and have never defaulted on anything. So when I received this call I was in disbelief. At first I thought this was a crank call, but they had called me and used my maiden name. This was really weird. So then I asked them what this was about and they would not tell me. She said that she needed to verify it was me to begin with. She needed my birthdate and after she had it she would get back to me the next week to confirm whether or not this was my account.

A week went by and no phone call till 6 weeks later. Then I recieved another phone call from them but from a different person. This person was rude and tried to pin this account on me. I denied it and told her I know nothing about it and that she needs to tell me what this is about. She also asked me to give her my birthday. Well I told her I had already given my birthday to the previous person and she said that she did not work there anymore. Now after learning about collection agency's and how they work I decided I was not going to give them anymore information untill I knew what this was about. I also explained to her that since they are calling in reference to someone with my old last name then wouldn't this fall under the SOL since it had been 10 years since my name was changed? plus if you go much more past that I was a minor so that would be 13 years ago. She said there is no SOL in Ontario and I then repeated the act and told her that there is and she still denied it. Then she tried to say that it must be my account then if I know all about this stuf and that I am looking into it. I told her that well if I am going to get a phone call from a collections agency or anything that I don't know about I am going to educate myself about it. She was really angry and tried to keep changing it to get me to say this was my debt. I kept telling her it wasn't and that I was not going to give her anymore information and that I was sorry that they lost the info that I had already given them. She said well fine then I will just have to keep calling. I said fine and then she hung up in a tiff.

Now I am just wondering what should I be doing with this. They can't even tell me what this is about.
I do not recall a debt and have never owned anything back before I was married except a student loan and that has been paid off long ago and I never defaulted on it. I also have excellent credit
Im not sure if I should just continue to ingnore them.

Please if anyone has some advice it would be much appreciated
