The best thing to do is get a hold of their ombudsman and let them know the how you are being treated by Mr.Manchester.If you can get this matter to one of the senior managers at presidents choice it will make a difference because collection agencies are difficult to deal with sometimes. Here is some info listed below that might help you. I would also write up a letter for the collection manager listed below and have the ombudsman forward your letter to them.

Aj, this kind of ties into the other thread I just replied to.

The PC Obudsman is a waste of time on this one.

Chuck Manchester is just like this, he takes debt collection very personally. Not the smartest way to collect debts but hey, thats his style.

Ask your lawyer about the limitations period and see if you can rely on that.

I had tried numerous times to try to work out monthly payment arrangements with them, but they never accepted anything I offered, I even offered up to $700/month at one time, even though I really couldn't afford that, and they turned that down. I was dealing with Chuck Manchester, if you know who he is, and he was an arrogant POS through all of this, they were threatening to me, so I had sent them a fax saying all correspondence had to be through fax, and the actually did that, which shocked me. Oh one of the last times they called me, I let it go to voice mail, and I hear him on the other line talking to someone, telling this other person to find out why I was using a fake name on my voice mail, my fake name on my voice mail, was my married name.

Good news, they got back to me, bad news, well not really bad news, wrong email address for my issue but they forwarded my email to the correct email address.

If you’re guilty of the debt why bother fighting it or changing the dates. If they get a judgment they will attach the judgment to the home. If he ever sells the home or tries to refinance; president’s choice will get their money plus the interest and court costs the court awards them. What is the total amount of the debt and have you offered them a settled amount?

I work for my husband's company, and my husband owns the home I live in. What do you think will personally happen? I did write to the ombudsman to see if we can get this settled before going to court, because the date they have set, I won't even be in the country, my lawyer is trying to get the date changed.

Do you have assets like a home or a good job for them to sue you? When I was sued by RBC they had a real law firm in my city handle the matter and not a collection agency.

My lawyer was served the papers and I have a copy of them, and its actually Canadian Debt Recovery aka Charles Manchester that is taking me to court on behalf of Presidents Choice.

Were you served by someone with the court papers? I find it hard to believe when I owed them $9000.00 and they never once mentioned lawsuit to me. Who is the law firm that is going to represent them?
