Communication with debtor

A collector must not continue to communicate with a debtor except in writing, if the debtor has notified the collector to communicate in writing only, and has provided a mailing address at which the debtor may be contacted

For example: This is to direct you to communicate with me in writing only at the following email address:

I recommend that you put this notification in writing to the collection agency and the creditor in a manner that would provide proof that this action has taken place. This could include fax with confirmation, email with confirmation, registered mail, or a cc of your email to the Mainland British Columbia Better Business Bureau. Be sure to keep a copy of the letter for your records. Fax Wiggins at 604-530-4977as faxing is the most efficient method of contact ensuring that you keep a copy of the fax confirmation allowing 4 to 5 business days for the business to process your information. If the calls do not stop, you can file a complaint with The BBB, or here: http://www.consumerprotectionbc.ca/

They have an office in Langley, BC. They've been calling every 2nd day or so. We even faxed them a signed letter last week saying thay have to stop trying to call, and can only continue to communicate in writing (at the address we provided). I heard of this law from section 12 of:

http://consumer.ic.gc.ca/epic/site/oca-c.nsf/en/ca01786e_3.html

We faxed them 3 days ago, and just today they called again. We asked them repeatedly over the phone if they received our fax, and they never said yes or no, just avoided the question, and said, "i don't know". I think these guys are breaking the law.

The first call they made, they came at me with all sorts of threats about having put the claim on my credit report, seizing assets etc.

It is obvious to me that the creditor did not give them the full story.

Their reply to that is they don't vouch for the integrity of their clients, they just want to collect what is owed.
