agreed vampchick21,

past due amounts can be sued in a small claims court setting, which is not criminal by any means. The only thing you'll get is a fair judgement which will make you pay what you owe.

The whole idea behind going to court is to help the creditor receive what he would have if you had paid your bills as agreed. The idea is to make the creditor whole.

You don't go to jail for debts in Canada. Lemme guess, the collection agency you were contacted by was Paul Kupferstein & Associates and you spoke to Mr. David?

If that's who you spoke with, laugh and report them to the Law Society of Upper Canada. They give out nothing but empty threats and the Law Society has a growing file on them.

Like Monty said, it's unlikely they'll take you to court for the amounts you owe, and you will NOT go to jail. And I'm pretty sure that they cannot garnish Welfare/Employment Insurance income. I know a former member, Raymond, gave a pretty good outline of the entire process an agency has to go through just to get wages garnished.

But if you were speaking with our dear friend Mr. David, it's nothing but an empty, useless threat that he cannot back up.

i owe about $900 to one company and the other about 200? when do they takeu to court/ and can i go to jail? if the garnishment is granted and im currently not working what happens?

Taking you to court is always a good threat... however, it's not what they do most of the time.

If the costs are too high, they probably won't take you to court.

very funny...i juz wanna make sure coz i was threatened they'll take me to court but i wanna know if i can go to jail

Yes you will go to jail and they will throw the key away lol. What they will do is send your debts to a collection agency after they can’t get a hold of you.
