Thanks, I will try that. I am just so frustrated right now. The stress is unreal and now everything I got the education for is at risk. I never intended to default. Life happened. I am going to check out that other sight tomorrow, too tired for tonight.

I didn't mean that, I meant call a trustee to give you some advice about student loans and their statue of limitations. I think you can get your answers over the phone. I believe they can't do nothing to you because it’s over tens years, just verify to make sure.

I would love to file for bankruptcy but I can't. I do that and I am no longer bondable and will lose my job....oh and my house. Trust me, I have thought of it over and over again but my job is something that I have wanted since I was in highschool.

I am not a 100% sure but if this debt is over 10 years old, I don't believe they can do anything to you now. I would call a bankruptcy trustee and he would be able to give you a straight answer on the law.

NCO and Student Loans

Postby barron121212 » Tue Jan 27, 2009 04:38:16 PM

Well, where do I start? I read most of the posts here and thought that this would be a good place for some advice/help/sanity.

My husband and I both have outstanding CIBC student loans. Anyone who has dealt with them know that they never set out reasonable payments. Long story short....ten years later they are now being collected by the pirannas at NCO. We have made payments when we could. Now, now it is getting really fun.

They made us a settlement offer in November. Went to CitiFinancial, couldn't borrow enough to make them happy. In the meantime we looked at moving our mortgage because of CIBC's right to offset and lo and behold, NO ONE (meaning a bank) will take our mortgage. We are now in the process of refinancing with the hope of enough to pay the suckers off with a secondary lender (scary I know).

Today, I get a call at work, after I have repeatedly asked them not to, and when I questioned why he was calling me at work, the yelling started. Apparently the settlement offer is off the table and they are going to sue. I came home, called the lawyer handling the mortgage transfer and she is sending them notice to cease and desist.

Anyone got any insight? Want more info? lol Any help would be great.
