I have been looking on www.classaction.ca but cannot find any forms, is this the correct site?

I also found this:

no sir, do NOT trust them to put you on any list. It is up to you to mail in the form found on the class-action website. It would also help to notify the law office handling the suit in your neck of the woods. You will not have to pay any charges to the lawyers in the case, the class action is certified.. You have til june 30 to notify cash store of your claim. They settled so as to avoid the loans from being deemed illegal , hopfully the law offices handling the money mart suit hold out for a judgment from the supreme court of Ontario... I was a damn good customer of theirs, caught in the PDL cycle for almost 3 years. Used exclusively the cash store, every two weeks. So I assume that this debt I owe them includes excessive charges?

I contacted their head office, all they would say is that anyone who qualifies would be contacted by mail. Since I had used their services extensively, for a period of almost 3 years, borrowing probably in the range of +$10,000 total, I would think I would be subject to those excessive charges. I am certainly not legally 'smart' lol. But if they were to sue me, do they have a case at all? These excessive brokerage fees I paid, surely must cover all(maybe more) or atleast a large portion of the $557 I owe.

the cash store has just settled a class action suit for their payday loans, 3 million to be payed out. Type in money store class action to get your money back...money mart is next, they go to court in april 09..

Based on that, I figured why am I wasting my time with this. So, I sent an email directly to Mr. Kupferstein himself. Shockingly enough, he replied. Informed me he has been retained by the cash store, to collect a debt owed in the amount of $557. Weird, I wonder where Mr. David got this $3000 figure. So I have asked him to confirm if he was suing me or not, or if he has any idea what so ever what this Mr. David is doing under his name.

Waiting his response.

Unfortunatly, because they hide behind the Kupferstein name, they can get around the Collection Agency Act and the Consumer Protection Agency won't touch them with a ten foot pole. You have to go to the Law Society for a complaint.

Even though a search in the BBB shows them operating under several names, some of them legal firms and some not (Liability Solutions or something like that).

In short, the folks calling you are NOT lawyers, are NOT paralegals. Not even legal secretaries. They are collection agents using a loophole. But even then, the Law Society has some pretty strict guidelines in collection practices undertaken by their members, and since Kupferstein is a member, he and anyone working for him MUST follow these guidelines. And the Law Society, unlike Consumer Protection, has teeth and uses them.

Thanks for the info vampchick21.

I think I will be calling back to the Cash Store and demanding another collector, as in my last conversation with them they did confirm they use several.

As far as the legal letterhead goes, since I have received no communication from them other than by phone, is it safe to assume they are calling to collect a debt and should be subject to the Collection Agencies Act(Which they have violated)?

I will definitely be following up with PhoneBusters, and most likely submitting a complaint to the Law Society of Upper Canada as well.

I received threatening, harrassing calls from them myself. BTW, the legal threats? Total bluff. "Mr. David" told me I was going to be charged with fraud, the police would be at my place of work within 24 hours and that I was going to be sued and the court baliff would be at my place of work within a week.

And yet nothing of the sort. Just empty threats designed to intimidate you and bully you. They inflate the amount owing as well.

I informed the PDL company that I owed the money to that I would NOT be dealing with that particular 'law office' (and frankly, it's a case of a collection agency using the law office letterhead) under any circumstances and surprisingly the PDL company transfered my file to Canadian Bonded Attorney (who I must admit, are highly professional, polite and more than willing to work with you to pay off a debt, unlike so many other agencies out there).

I reported Kupferstein and friends to the Law Society, and apparently they have a nice little file growing on them. I suggest you do the same. It's one thing to attempt to collect a debt, but this lot use the Kupferstein letterhead in order to get around the Collection Agency Act of Ontario, and that cheeses me off to no end.

You might want to ask them what kind of settlements are available.

Forgetting about it is probably not your best course of action.
