Golden Oldies and Blasts from the Past

Postby Raymond » Thu Dec 18, 2008 05:55:53 PM

To mark the year end I've been going over all the posts I've received and picking my favourites.

I welcomed the great majority but the most appreciated were the scathing and viscous ones. There are so many worthy choices but the one I enjoyed the most was from Pakistani collection agent "Boz Ahjeet" whose 2 posts on Nov.17, 2007 reminded me what a pathetic excuse for a human being I was. Somehow Boz's ID got changed from "Boz" to "zasxer99" when the forum was reformatted shortly after.

It's the post immediately preceeding Monty's post welcoming collection agents to the forum to share their "insights" and "pearls of wisdom" with us.

On the other hand, there were 3 that actually hurt. They were from guys who accused me of being a collection agent [in disguise]. Ouch! That's hitting below the belt!

No, the "Date of Last Activity" will not change on a delinquent account, irregardless of whether or you pay it off or not. See my lengthy Nov.11 post on it in the link below. On a debt this old, I wouldn't offer them a very high percentage. Let them scream at you and hang up a few times before you agree to anything though.

And no, you can't REVIVE or RENEW the satute of limitations on a debt like this by making a partial payment or taking out a front page add in the Toronto Star acknowledging it.

Your considerations at this point are purely moral ones.

Hi Raymond,
Thanks for your reply. If I decide not to settle with this collection agency, are there any ramifications? Can they put it back on my credit report and ruin my credit? What is it that they can do?
Thank you

The 6 year limitation rule applied in 2002 to unsecured debts in Ontario and so it's stats barred by now.

Collection agencies are shovelling especially hard this season making last gasp attempts to dig up the corpses of dead debts in a frenzied effort to pad Christmas bonuses for their bosses.

There are moral aspects to the debt as well and so let your conscience be your guide if you decide to settle for extra-legal reasons.

D&A calling me for 2002 debt

Postby Ric_Singh » Thu Dec 18, 2008 11:16:53 AM

Hi there,
I defaulted on payment for Enbridge in 2002. And I was trying to settle with them in 2006 but they wouldn't settle. It actually got removed from my credit report in 2007.
Today I received a call from D&A trying to collect that debt.
Do I have to pay that back since it was actually removed from my credit report as well? I never received any letter indicating that I owed this money either. Since it was removed from my credit report I thought that the debt was wiped off.
Any advise?
Thank you
