OK...there is a list of questions that are illegal for the employer to ask and directly asking outright if you have a mental illness is one of them.

Now what they can and are supposed to do is ask if you have any conditions that may prevent you from accomplishing the tasks required by the conditions of your employment? Then it is up to you to decide whether you wish to disclose that or not.

The employer cannot turn around and fire you because it would be a legal minefield for them. Think "sued for wrongful dismissal" for one.

You are welcome Franniee!
Yes, I agree, this is a great site, I just stumbled onto it today.

The system doesn't always work, but there are definite laws in place to protect people... Unfortunately sometimes these same laws also protect the employer who is about to or has done something wrong towards a person.

Always go into interview with open mind, if you go into an interview "expecting" a problem, then you will "find" one. It's rather like Murphy's Law "if anything can go wrong, it will"

Never give up, all situations and people involved are unique.

Personally, I've struggled for over 2 years to find reliable employment to support my family and have had no luck.

I've exhausted all opportunities and turned to the internet now to give it a whirl... it's definitely fun and worthy of my time and energy and I'm learning and meeting new people. I love it!
Still, I continue to "hunt" for JOB , it's also nice to be out among members of your community and not stuck to a desk chair ~ LOL

Good luck with your hunt for an employer worthy of your time and energy!

Hi Franniee

In response to your post >> When you apply for a job does the employer have the right to ask if you have a mental illness And if say you do and your on pills and have not had a problem in like 5 years do you still have to answer yes to this question Or if you say no and they find out you lied can they come after you and fire you for lying

It is my understanding that our personal matters are not an employers business unless it would directly affect your ability to perform your job duties.
You should consult with a Human Resources and Development Canada representative or the Employment Standards office or whatever they call themselves these days. Tell them exactly what your concerns are and ask them "legally, what may a potential employer ask you during an interview or while you are working for them"

There are laws that are supposed to protect people from potentially discriminating employers. In fact, if you go to www.monster.ca and search inside their site, it's great, there is a great deal of information that will help to prepare you for job interviews, etc... but, definitely contact HRDC.

Good Luck!

Mum's the word Franniee. They're not going to hire you if you tell them anything. And if you do, it could conceivably end up on your credit report and then you're screwed,
