I would investigate on how they got the judgment and when they got it. Were you at the same address or same job since 2004 because they need to show the judge they tried to track you down to serve you? I believe there is a way to fight it if they went about it the wrong way.

i made my last payment in dec 2004, like you said it should have been stats barred, but now apparently i was being sued and it went to court without me knowning and a judgment was passed, and now they are garnishing 30% of my wages until its payed off. Now i can't even afford rent or food and i'm facing eviction. Thanks for all the great advice!!

If the last time you made a payment on this account was in 2004, they can not do anything to you. If I were you; I would just ignore their calls and this item will fall of your credit file next November 2004. If you do talk to them; I would tell them that the statute of limitation to sue you has expired and now your considered stats barred.

I would not admit over the telephone or in writing you owe the debt. If they think you know the law; I believe they will back off with the telephone calls and leave you alone, unless your debt goes to another collection agency. If that happens tell them the same thing.

hi people i haven't wrote in a very long time, since my post on page 3 of this topic, i haven't got any phone calls from the vultures being discussed... until today, like i stated before my last payment was december 30, 2004. What can they do to me, cuz honestly i am in worst situation then before being 1 of those affected by this "recession" and i just can barely afford to support my family, and now they are hounding me again.

I think I've dealt with one or two that were dismissed due to actually being stat barred, and I'd say about 20 that were still suable." What are you smoking?? They bought thousands of stat barred loans back a few years ago.Why dont you just go back to kissing aktivs butt which it seems you are real good at.

Yeah, they're a lot like the zombies that you see in Michael Jackson's "Thriller" video - except these characters aren't acting.

You can see how people of normal mental persuasions react to the prospect of working for a collection agency like Total Credit Recovery.

Wow, so I just came back to read Kwalaleles response.
First Im not sure if kwlalala is a he/she/IT.

So I'll just refer to IT.
Its trying to get under our skin, but its not working. I suggest we just ignore kwalalals pleas for people to pay the debt which they cant...because Kwalalas prolly working for Aktiv and has been given an ultimatum, perform, get some results or youre fired.

Incidentally, there are none who should read Vampchick's last post more carefully than Monty Loree or, for that matter, any purchaser of Mark Silverthorn's book. Both know full well how completely useless Brian Pitkin and the Ministry of Consumer Protection is, and yet both of them keep plugging it endlessly.

Monty should know because he's got 7300 posts on his site telling him so in addition to the best source of all....Brian Pitkin, himself. If Brian Pitkin doesn't know about Brian Pitkin, who the hell does???????

Mark Silverthorn must know; he says he's worked with or been involved with every major collection agency in Ontario for 12 years. As such, he's privy to what they get away with. And so, it's got to be the worst kept secret around that the Ministry of Consumer protection is a collection agent's best friend. Surely, if people like Vampchick know that, Silverthorn does too.
