Your best bet with CBV is to call 1-800-889-9768, go through the automated thing and talk to a person. They will instruct you to write a letter to CBV stating that under the collection agency act your only allowed to contact a consumer 3 times within a week and you exceed this within x days or hours and that if the behaviour continues that you will file a formal complaint with the ministry of consumer services office of the registrar. They will then give you a file number so that if these guys continue you can do a follow up and actually file the formal complaint. I have kept the letter on my computer and in my purse so that i have it on hand every time they call and i do the broken record thing and repeat the letter to them which states all this. The calls are slowing down fast and they aren't hassling me multiple times an hour. This is all over the fact that Direct Energy hooked up a utility in a city i do not live in and never have, using my birthdate. The bill is 205 and they tell me every time i talk to them that i need to file a complaint with the RCMP but then they refuse to give me a letter of settlement, which i need to file a complaint with the RCMP to get these calls to stop. Basically making a huge run around, so that i cant stop these calls and put them on the radar of BBB. Then, after refusing to provide what they say i need to file and what the RCMP say i need to file a complaint, proceed to ask for more personal information. Now when i refuse to give them my SIN or any sensitive information, they take a tone and eventually start to yell and swear at me. Then when i call back and speak to a supervisor i get the same belligerent attitude and same yelling as i did earlier. So my suggestion is call 1-800-889-9768 and file a complaint. They get enough complaints these guys will be shut down. They break multiple laws and they need to be stopped. So lets let our fingers talk for us and team up and shut these guys down.

"In Alberta, the collection agency must provide you with documentation of the debt within 30 days... or must provide you with a letter stating they are unable to provide the requested information and a reason why they cannot."

Hi Angella, that was your quote in your previous statement. Do you know what the law is in Ontario? Anyone on this forum know the law in Ontario?

Calgarian,

In Alberta, the collection agency must provide you with documentation of the debt within 30 days... or must provide you with a letter stating they are unable to provide the requested information and a reason why they cannot.

Request that documentation by registered letter... and insist upon getting either or. You can use that to remove it from Equifax.

Collector... dude... hopefully you don't have a blood pressure problem. Calm down a little willya? Almost sounds like you've got a complaint against you eating at your hide...? :D

I get the sense that if the debt can be proven to be his, he is more than willing to pay it. Asking for proof of a debt you don't recognize is not out of line. In fact, it's the smart thing to do.

And, no, debts don't always get collected. In fact, in Alberta, if you contact them more than 6 years past the last written acknowledgement or payment you are in violation of the laws.

Y'all ain't as powerful as you like to believe you are.

Hey collectorinrage, you know what? If Telus would have done anything to try and track me down before it went to collection then it would have been dealt with then, but instead they sell it to a bottom feeder collector who couldn't give a rats a** about anything. Until the last year Telus just took information over the phone such as name, birthdate and address and they gave service. ANYONE could have called in and got a phone. The only reason Telus has sold these so called debts is because people finally have decent alternatives and they are scrambling for cash.

I don't owe 'interest' because I actually don't even own the debt, iand f I never had an agreement with them in the first place, then you can shove your interest up you little weasel butt.

For the 20 years of of accounts and payments that are on my credit file I have never had one late payment, a collection or a judgment and now my credit has dropped to 655 because of $165.

I have spent countless hours on the phone, wrote letters, emailed and faxed, with the latest being an offer to CBV to pay the debt with a $300 administration fee to remove the item from my credit file and I am still waiting to see if them accept my offer or not. I have never ONCE gotten a letter, a phone call or anything from CBV.

Cops won't do anything about the phone, Telus doesn't have the debt, collection agency has screwed up my credit, and now I am getting blasted by the same jerks I am trying to deal with.

I hope one day something happens to you a**hole, so you can understand why it really feels to be on the innocent end of your business... And it doesn't take much. Look at this board. Even movie late fees now have the ability to mess up your credit.

I am not EVER going to give CBV or any other collector a cent until I make sure my credit is protected.

Why dont't you lazy losers just pay your bills and stop looking for loop holes out of debt. You Got your self into this mess, be an adult and figure it out for your selves. Making complaints about collectors doesnt get them fired or erase your debt. It takes a long time to collect but does get collected and in the time it takes to get the complaint worked out, your accnt has been building intrest and you owe more money. OH WELL thanks

I'll try again at Telus. I also wrote the collection agency to send any information they have, including original creditor documents, will update if any success...
