What I would do in your case is provide them with a hardship letter outlining your current situation. Along with that I would provide a financial statement to them advising of what you currently pay out each month and how much money you have left over. As long as you do this there is not much that they will do, I would also suggest trying to make a small payment to the account each month to show them you do have intentions of repaying this debt. No creditor and/or collection agency can refuse a payment no matter how small it is and if they decide to take legal action you can show the judge the letter and statment you sent to them. As well he will look at the small payment you did make and probably dismiss the action.

Are you currently working to pay for school or on a student loan?

Help!

Postby pift1984 » Tue May 06, 2008 09:29:37 AM

Ok I need some advise and I have a question.
I decided to goto school 2 years ago and I ended up not being able to balance school and my debt so most of it went into collections.

My current problem is with an auto loan from a bank. Being in school I can't pay anything right now however as soon as I've graduated I'm going to start paying off all of these debts.
The most recent letter I've received from black/sutherland LLP threatens to to have the claim served on me by the sheriff. This is accompanied by draft for the superior court of justice.

I haven't paid anything on this debt because I've been scared of not being able to afford school.

I just want to know how much power this agency has and if there is a denomination of monies owed that they usually take it a step further.

I know this may notbe very clear if you have any questions I will answer them.

thank you
