A letter stating this debt is not and never has been accrued by you and requesting verification of their claims in the form of contracts, statements of account, etc would not reset it.

A letter stating "I know about this debt, and refuse to pay it because" does reset a statute of limitations.

Write a letter in the format of my previous post and you'll be fine.

A date from 2002-01 is not only stats barred, but as of January it became illegal for a collection agency to contact you with regards to this debt... that is if the debt was allegedly incurred in Alberta.

thank you for the reply. yes you are right, no point in risking it. I am pretty sure but I want to make sure, in Alberta this account would be considered stats bar? And to file a complaint I would contact the Alberta consumer protection?

Some would say that you cannot reset the statute once it is expired. I say it is simpler not to take the risk.

You are only acknowledging the debt if you admit owing it... now or ever.

Simply stating you do not recognize this debt and that it clearly cannot be your debt as you a) never lived at the billing address and b) were only 17 and you would like to see some evidence of this debt would not ever be construed as acknowledging the debt.

I also have been dealing with CBV collections regarding factored telco (telus) that appeared on my credit on November 07, regarding a dept dated from 2002-01 for a phone number i never had at a address i never lived at. further more, i was 17 at the time living with my parents.

Any ways, i was just about to send a registered letter to CBV disputing the collection and the one agent informed me that if i did send one then that would be considered a written acknowledgment of the dept and would restart the term. also i told them many times that they are presuing a dept beyond 6 years, which gets me the reply that "after 6 years they can no longer report to the credit burro but they can still collect.

my question is, will the letter of dispute be considered a written acknowledgment of the dept? and are they even allowed to try and collect this dept? thank you
