Mam,I am sure you are aware of the fact that Student loans in Canada are not discharged in a bankruptcy unless they are over 10 years old.They are planning to change the law ,where in Student loans in Canada will be discharged in a bankruptcy if they are two year's old.We are expecting the law to come in to force later this year or early next year hopefully.Visit http://www.student-loan-bankruptcy.ca/ to learn more.

They r taking my tax refunds which are pretty miserable to begin with.

I have provincial and federal loans. If I had a good income this would be paid already.

If the government goes after you it does. They cannot, and will not, take everything. Not in Canada.

Meanwhile, making the payments you determine you can afford will go a long way towards ensuring the do not go after you... just make sure it is reasonable. The government is aware of how much money you make. For the most part they're not smart enough to figure out how to share information, but when it comes to owing them money they figure it out pretty damn quickly!

Make sure you keep the payments reasonable to your income and they'll be fine with it. They will probably, unless you have an arrangement with them, garnishee income taxes, GST, etc. If you have a low income that is about as far as they will go... and if your income is low enough they won't even go after GST.

If the government asks for that information you would be advised to provide it in attempt to work out a deal. If a collection agency asks for it, personally, I wouldn't.

Demand that the collection agency send you a breakdown of the principal and interest accrued since the start of the loan. Demand that they send you their authorization to collect this loan... or a contact at the government you can use to verify the assignment. You can then contact that person directly and explain that you are not willing to disclose personal financial information to outside parties and see what you can arrange with him.

When it comes to the government, it is always best to deal with them directly... and they can actually be pretty reasonable about it.

This is a FEDERAL student loan, if they were going to garnish your wages, they won't need your personal cheques to determine where your account is.

And I know from experience, the federal government will not settle their student loans.

Are your income tax and GST returns being seized yet? Who is the original creditor?

You're not obligated to fill out the financial questionnaire, but you may want to, but just not sent it back to the agency. Fill it out, and determine how much you can repay based on your household income. Just remember, if you are only going to pay $50 a month, that might not even cover the interest that still accrues daily. Remember, that financial questionnaire is only showing the agency how much you can repay.

I wouldn't worry about being paranoid about the personal cheque thing, however I don't know anything about TCR.

The less collection agencies know about you the better. By providing them with your bank account information if they do sue you, you are simply telling them where to go to garnish bank accounts.
