Marie, just note that even though this account is passed it's Statue of Limitation, and you cannot be sued doesn't mean they won't call you 3 times a week to demand payment on your account. They may not because they know you know they can't sue you (not that they probably ever intended to) but you never know.

Well I have to give a HUGE thank you to all of you guys who helped me through this. I was actually able to prove that the account the collection agency was refering to was stats barred. They literally tried every trick in the book on me....hoping that I was going to be intimidated by their tactics. I used my Equifax credit report (which is the report they were refering to). The agent actually stated information that was not true re: dates of activity on the account. (which did not show on my report).
After speaking to him this morning....he admitted that the account is stats barred and that they can not sue me but they could request payment.......I told him good luck with that.
The funny thing is that it went from him calling me.......to me calling him ...once I started requesting information he started stalling and then I was in control...... It is over. No more phones calls!! Thanks again.

OK......so I think I have some good news! I mentioned earlier about the agent telling me that this account is on my credit report and that there was a payment made in June 2002. He said it was on Equifax.......I got my credit report online from Equifax and this account is not on there!!
I also had asked him to send me the history on this account (by email) and I am still waiting. He said it would take about 10 minutes......that was 3 hours ago. If this shows up on my credit report now I have proof that it was not on there today. !!!!

What kind of "dirty tricks". Could they actually change the dates............because in this case they must have done that to work in their favour. I am baffled and feeling victimized by these guys.

All the time! Some of them even tried to re-age it by using some dirty tricks. Is that right Jamie? You know your kind does it all the time.

That's why I said you have to get your own proof. The date on your credit report is ok. Also, contact the original creditor to see if you can still demand an activity statement.

Well apparently they can file a claim and hope I don't respond and then get a default judgement against me.......then garnishee my wages.
I am going to have to call them because now the whole process is time sensitive and not to my advantage. I am going to ask them for a complete history of the account because I am questioning the validity of this account. Upon reading some of the other threads in this forum ......I could be paying something that doesn't even exist...... to someone who is not the original creditor.......and ruin whatever credit I may have......
This whole situation is wearing me out...............

Just spoke to the guy requesting a history of the account and he said there was a payment made June 2002 which is an outright lie......which makes the SOL June 2008. I did not make this payment..........
Could they actually be lying about this????

Thanx ranzzzz.......I am going to get a copy of my credit report. It will probably show (or not) this account they are talking about....at least maybe the date of activity. The agreement with my ex was an amicable arrangement. I had no reason to beleive he wouldn't pay this. In the end the account has my name on it.
I am going to stand my ground re: SOL
