No you can not refuse....they can simply drop them in front of you....there is nothing you sign. They can not re instate the Stat...unless they can prove you acknowledgd the debt within the 2 year time limit.

No I don't have the recording. Yes it is stats barred..and he told me that they reinstated it?? and that I ignored papers sent to me DA..I never received any letters from MBNA recently..did 2yrs. ago..but not recently. So can I refuse these papers IF

Lets for the sake of argument assume that the collection agency now owns the debt....anyone can serve the statement of claim as long as they then file with the court that it has been served. They could also serve on behalf of the original creditor .

collection agencies and lawyers are regulated... collection agents and agencies must be registered to deal in your province... if they are not, they cannot collect. best to call your local consumer protection and ask if it's a collection agenc
