Bankruptcy A proposal is a service given to creditors to resolve your debts and is provided by a Trustee or an Administrator under the provisions of the Bankruptcy and Insolvency Act. There are several advantages of a proposal. First is that when a proposal is accepted by your creditors, it lets you pay for your debts not needing to go into bankruptcy. Second, a proposal will usually influence your credit rating for a shorter period of time than a bankruptcy.

There are two types of proposals under the Bankruptcy and Insolvency Act. A consumer proposal is utilized if you have less than $250,000 of debt, not including the mortgage on your principal residence. A Division I proposal is used in those cases where you do not meet the criteria for a consumer proposal.

Once a proposal has been filed, no creditor can persist on doing any action, garnishment, proceeding or seizure against you or your assets without leave of the Court. If someone has, or is threatening to, take hold of any of your assets or garnish your wages, you must contact one of our offices and right away ask for advice as to your rights.
